Definitions

In these terms & conditions, the words "Arts & Business” shall mean the registered charity, Arts & Business Limited, which has its registered office at Nutmeg House, 60 Gainsford Street, London SE1 2NY, “Site" shall mean the Arts & Business website and the phrase "the Service" shall mean the services and facilities made available through the Site.

These terms & conditions of use, and your use of the Site and/or the Service, shall be governed by and construed in accordance with English law and the English Courts shall have exclusive jurisdiction in connection with all matters relating to these terms and conditions of use.

Terms of Use for the Advice Line

The Advice Line provides general assistance in a time limited manner. By its very nature it relies on you to help to identify key facts and information as a basis for our discussions. It does not purport to provide comprehensive advice based on all the relevant facts, issues and circumstances but merely seeks to help you identify areas where further work or professional assistance may be required.

Arts & Business, their legal partner in relation to the helpline, Russell-Cooke LLP, and any other third party you are referred to, will use their reasonable endeavours to assist you in identifying areas of concern where further assistance may be required but do not assume a duty of care towards you in relation to the subject matter of the call. Neither Arts & Business nor Russell-Cooke LLP warrant or represent that such assistance will be comprehensive or complete. Arts & Business, Russell-Cooke LLP and other third parties shall use reasonable care and skill in carrying out the services in relation to the Trustee Advice Line but you should not rely on that advice as a substitute for specific legal advice based on a full understanding of the facts, issues and circumstances involved. All warranties, conditions and other terms implied by statute or common law are, to the fullest extent permitted by law, excluded from this agreement.

Advice Line Limitation of Liability - The Customer's Attention is Particularly Drawn to this Clause
Except in relation to liability for death or personal injury or fraud, for which no limit applies, the liability of Arts & Business and/or Russell-Cooke LLP for direct loss arising out of the use of the telephone helpline, whether based in contract, tort, strict liability or otherwise, is excluded in its entirety.

Subject to the preceding clause in no event shall Arts & Business or Russell-Cooke LLP be liable for any indirect, incidental, special or consequential damages arising out of or in any way connected with the use of the telephone helpline or with the delay or inability to use it whether based in contract, tort, strict liability or otherwise, even if Arts & Business or Russell-Cooke LLP has been advised of the possibility of damages. In particular neither Arts & Business, Russell-Cooke LLP or any other third party shall be liable for:
(i) loss of profits; or
(ii) loss of business; or
(iii) depletion of goodwill and/or similar losses; or
(iv) loss of anticipated savings; or
(v) loss of goods; or
(vi) loss of contract; or
(vii) loss of use; or
(viii) loss of corruption of data or information;
(ix) any special, indirect, consequential or pure economic loss, costs, damages, charges or expenses.

 

- What data does Arts & Business collect from users of the Site?
Arts & Business collects data from you ("User Data") at points in the Site when you register an interest in receiving information, enter competitions, use the Service or purchase one of our publications.

 

- What use does Arts & Business make of User Data
Arts & Business will use User Data that it collects from you only in accordance with the following guidelines:

i. To provide the Site and the Service for you
Arts & Business will use User Data to provide the Site and the Service, to notify you of any changes in them or in the terms and conditions of use of the Site and/or the Service.

ii. To send you information about other products & services provided by Arts & Business
From time to time, Arts & Business, its partner organisations or third parties acting on its behalf, may wish to send you information about other services and products which it offers, and in which it believe that you may be interested, and it may use User Data for this purpose.  If you decide now, or at any time in the future, that you do not wish to receive this information, please inform us at contactus@artsandbusiness.org.uk  

iii. Internally within Arts & Business
Arts & Business may make User Data available to other parts of its organisation, either for the delivery of its products and services or to enable them to provide you with information about products or services which they believe will be of interest to you.

 

Legal requirements

While it is unlikely, Arts & Business may be required to disclose your User Data by a court order or to comply with other legal requirements. Arts & Business will use all reasonable endeavours to notify you before we do so, unless we are legally restricted from doing so.

 

- No commercial disposal to third parties
Arts & Business will not sell, rent, distribute or otherwise make User Data commercially available to any third party, except as described above or with your prior permission.

 

- Assent to terms of privacy policy
By using the Site and/or the Service, you acknowledge that you have read the terms of this privacy policy and that you agree to Arts & Business using User Data for the purposes set out above.
